1. Purpose
These Terms of Use (the “Terms”) govern access to and use of the BeOpen application (the “App”) and related services (the “Services”). BeOpen enables proximity-based voice discussions to create authentic, friendly connections.
The Terms define rights and obligations between the user (the “User”) and the publisher (the “Publisher”). Any registration and/or use of the App implies full acceptance of the Terms.
2. Acceptance & changes
By creating an account or using the App, you acknowledge that you have read and accept these Terms without reservation. If you disagree with any part of them, please do not use the Services.
The Terms may be updated at any time to reflect changes to the Services or applicable laws. The current version is available on this page. In case of material changes, we may notify you in the App or by email. Continued use after changes constitutes acceptance of the updated Terms.
3. Account & security
- Sign-up: access requires creating an account via a third-party identity provider (e.g., Google, Facebook). You agree to provide accurate information and keep it up to date.
- Minimum age: the App is not intended for persons under 18.
- Credentials: you are responsible for keeping your credentials confidential and for all activity on your account. If you suspect unauthorised use, contact support immediately.
- One account per person: identity theft, fraudulent multiple accounts or account sharing are prohibited.
- Checks: we may perform anti-spam/anti-fraud checks to keep the community safe.
4. Service access
The Services are normally available 24/7. Temporary interruptions may occur for maintenance, updates, technical improvements or force majeure. We strive to minimise downtime.
Some features may depend on your device, OS, App version, network connection, location or granted permissions (e.g., microphone for voice).
5. Offers, subscription & payment
- Model: BeOpen may offer a free version and/or paid options (subscription, in-app purchases, promotions, advantages linked to challenges).
- Payments: handled by distribution platforms (Apple App Store / Google Play) or our processors. Their terms and refund policies prevail.
- Renewal: unless otherwise stated, subscriptions renew automatically until cancelled in the store settings before the billing date.
- Trials & promos: specific conditions (duration, scope, eligibility) are shown in-app at the time of the offer.
- Challenges & perks: some offers may grant conditional advantages. Eligibility and validation criteria are described in-app.
6. Conduct & content
You agree to use the Services fairly and respectfully. The following are prohibited:
- insults, harassment, threats, hateful or discriminatory content;
- illegal, defamatory, pornographic, shocking or violent content;
- spam, unsolicited advertising, prospecting or phishing;
- identity theft, deception, manipulated media, rumours;
- unauthorised data collection, doxxing, privacy invasion;
- any attempt to disrupt, bypass or degrade the security or operation of the Services.
You retain your rights to your content. By publishing/broadcasting via BeOpen, you grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce and display such content solely to technically operate the Services (hosting, display, moderation, backups).
Compliance with our Community Guidelines is mandatory and forms part of these Terms.
7. Moderation
To keep the environment safe, we provide reporting tools, automated systems and a moderation team. We may remove content, restrict features, temporarily suspend or terminate accounts in case of violations of the Terms, the Guidelines or the law, or upon requests from competent authorities. Measures are proportionate to the severity and recurrence.
8. Intellectual property
The App and all its elements (logos, distinctive signs, interfaces, texts, sounds, graphics, databases, code) are protected by intellectual-property laws. Any unauthorised reproduction, representation, extraction or use, in whole or in part, is prohibited.
9. Personal data
Data processing carried out through the Services is described in our Privacy Policy. For information, we may receive certain data from your identity provider (e.g., name and email), but we store only your email address to authenticate access and manage your account. We do not sell your data and do not display tracking-based advertising.
10. Availability & maintenance
We make best efforts to ensure availability, quality and security. Maintenance may be scheduled or urgent. We may add, remove, modify or suspend features, temporarily or permanently, without compensation.
11. Warranties & liability
- No warranty: the Services are provided “as is” and “as available”.
- Limitation: to the extent permitted by law, we are not liable for indirect damages, data loss, loss of opportunity, nor for issues attributable to third parties (carriers, stores, processors) or to your equipment/connection.
- Security: while we deploy appropriate measures, no system is infallible. Please take reasonable precautions (updates, access management, caution with links).
12. Termination
- By you: you may delete your account at any time from the App or by contacting support. Timing may depend on store technical processes or limited legal retention.
- By us: we may suspend or terminate access in case of violations of the Terms/law, fraudulent use or to protect the community.
- Effects: termination does not affect amounts due for prior purchases; store refund policies apply.
13. Third-party links
The Services may contain links to third-party sites or services. We do not control these external resources and disclaim any responsibility for their content, practices or security. Access is at your own risk.
14. Distribution platforms (App Stores)
When the App is downloaded via a platform (Apple App Store, Google Play), that platform’s terms and policies apply in addition to these Terms, notably for payments, renewals, refunds and reporting.
15. Governing law & disputes
These Terms are governed by French law, subject to mandatory rules of the User’s country of residence. In case of a dispute, an amicable solution will be sought first. Failing that, competent courts will be seized in accordance with applicable procedural rules.
16. Miscellaneous
- Entire agreement: these Terms constitute the entire agreement between you and the Publisher for the Services.
- Severability: if any clause is invalid, the remaining provisions remain in force.
- No waiver: failure to exercise a right is not a waiver.
- Assignment: the Publisher may assign the Services in compliance with applicable laws; you will be informed where required.
- Language: in case of translation, the French version may prevail in case of ambiguity.
